Terms of Service
These Terms of Service (the “Terms”) govern the relationship between Miami Palm Beach Realty LLC (“Brokerage”) and its clients (“Client” or “Clients”) regarding real estate brokerage services in Florida. By engaging the Brokerage’s services, you agree to be bound by these Terms.
- Services provided
- The Brokerage, licensed in Florida, offers real estate services including property listing, buyer representation, and property management, in accordance with Florida law and the latest Code of Ethics & Standards of Practice of the National Association of REALTORS®, as amended.
- Specific services and their scope will be detailed in a separate written agreement (e.g., Listing Agreement, Buyer-Broker Agreement) signed by both parties.
- Brokerage relationships
- The Brokerage will clearly disclose the nature of the relationship with the Client (e.g., single agent, transaction broker) in writing, as required by Florida law, and specify the duties and responsibilities associated with that relationship.
- For buyer representation, a separate Buyer-Broker Agreement will be required before viewing homes, outlining responsibilities, compensation, and other relevant terms, according to recent legal changes in Florida.
- Client responsibilities
- Clients agree to provide accurate and complete information relevant to the real estate transaction.
- Clients are encouraged to seek professional advice (legal, inspection, etc.) on matters beyond the Brokerage’s expertise, particularly concerning property condition, legal contracts, or financing.
- Compensation
- The Brokerage’s compensation for services rendered will be outlined and agreed upon in a separate service agreement.
- Commissions are negotiable and not set by law.
- Any potential for additional or offsetting compensation from other parties will be disclosed.
- Confidentiality
- The Brokerage commits to maintaining the confidentiality of Client information in accordance with Florida law and the NAR Code of Ethics, unless disclosure is required by law or with Client consent.
- Clients acknowledge that, unless otherwise agreed or mandated by law, the existence, terms, and conditions of offers may not be treated as confidential by sellers or their representatives.
- Disclosures
- Sellers are required to disclose facts or conditions known to them that materially affect the value of the property, including issues that would reduce its value or desirability.
- The Brokerage will disclose any known material defects, conflicts of interest, or relevant property information in accordance with Florida law and professional ethics.
- Limitation of liability
- The Brokerage acts as an intermediary, facilitating real estate transactions.
- The Brokerage is not responsible for the accuracy of information provided by third parties (e.g., sellers, inspectors), except as mandated by law.
- The Brokerage recommends Clients independently verify all information before entering into any agreements.
- Dispute resolution
- The Brokerage encourages open communication and negotiation to resolve any disputes that may arise.
- In the event of unresolved disputes, mediation or arbitration may be explored as alternative dispute resolution methods.
- Should a formal complaint be necessary, Clients may contact the Florida Real Estate Commission or the Attorney General’s office.
- Governing law
- These Terms are governed by the laws of the State of Florida. Venue is Palm Beach County.
- Modifications
- The Brokerage reserves the right to modify these Terms periodically. Clients will be notified of any changes.
By engaging in the services of Miami Palm Beach Realty or its affliates or using this and our affiliates’ websites, you signify your understanding and agreement to these Terms of Service.
